Caroline just wants her computer to work — "please don't change a thing — it worked yesterday — if it breaks before my presentation I'm screwed!" Can both their needs be met? I think so! But it’s easy to completely miss where interests and needs can both be met when the language is so easily interpreted to mean the problem is untenable."

Hugh Pickens writes "In hospitals around the country, nurses connect and disconnect interchangeable clear plastic tubing sticking out of patients' bodies to deliver or extract medicine, nutrition, fluids, gases or blood — sometimes with deadly consequences. Tubes intended to inflate blood-pressure cuffs have been connected to intravenous lines leading to deadly air embolisms., intravenous fluids have been connected to tubes intended to deliver oxygen leading to suffocation, and in 2006 a nurse at in Wisconsin mistakenly put a spinal anesthetic into a vein, killing 16-year-old who was giving birth. 'Nurses should not have to work in an environment where it is even possible to make that kind of mistake,' says Nancy Pratt, a vocal advocate for changing the system. Critics say the tubing problem, which has gone on for decades, is an example of how the FDA fails to protect the public. 'FDA could fix this tubing problem tomorrow, but because the agency is so worried about making industry happy, people continue to die,' says Dr. Robert Smith." This reminds me of the sort of problem that Michael Cohen addressed in a slightly different medical context (winning a MacArthur Foundation grant) a few years ago. That's how it appears in the Congressional Record, though the Library of Congress has it listed as The XXXXXXAct ofXXXX. As for what's in the bill, well that appears to be as mysterious as the name. It was officially announced as a bill to tax bonuses to execs who received TARP money. But then someone simply deleted the entire bill and replaced it with text about aviation security. And then it was deleted again, and replaced with something having to do with education. However, because of these constant changes, many of the services that track the bill have the old details listed. On top of that, Nancy Pelosi called the House back for an emergency vote on this unnamed bill, and anyone trying to find out what it's about might be misled into thinking its about aviation security or something entirely unrelated to the actual bill. Tenenbaum, the Court has reduced the jury's award from $675,000, or $22,500 per infringed work, to $67,500, or $2,250 per infringed work, on due process grounds, holding that the jury's award was unconstitutionally excessive. In a 64-page decision (PDF), District Judge Nancy Gertner ruled that the Gore, Campbell, and Williams line of cases was applicable to determining the constitutionality of statutory damages awards, that statutory damages must bear a reasonable relationship to the actual damages, and that the usual statutory damages award in even more egregious commercial cases is from 2 to 6 times the actual damages. However, after concluding that the actual damages in this case were ~ $1 per infringed work, she entered a judgment for 2,250 times that amount. Go figure."
